Welcome to Spk.sg. These Terms of Service (the “Terms“) are a binding legal agreement between you and SPK Singapore Pte Ltd. (“SPK Singapore”, “Spk.sg” or "we", "us", “our”), regarding your use of the Spk.sg website and services at Spk.sg (the website, services, and products purchased are collectively referred to as the “Service“).


We may periodically make changes to these Terms. By accessing or using the Service, you accept this Agreement and any modification that we may make to the Agreement. It is your responsibility to review the most recent version of the Terms frequently and remain informed of any changes to it.

The Terms Of Use spells out your relationship with SPK Singapore and the terms and conditions under which SPK Singapore offers for your access to our services.

The information is provided by SPK Singapore and whilst we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, expressed or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising or in connection with the wrongly installed or fitted parts after purchase. We strongly advise that all automotive parts shall be installed by qualified mechanics only.

Through this website, you are able to link to other websites which are not under the control of SPK Singapore. We have no control over the content and availability of those sites. The inclusion of any link does not necessarily imply liability expressed within them.

Every effort is made to keep the website up and running smoothly. However, SPK Singapore takes no responsibility for and will not be liable for the website being temporarily unavailable due to technical issues beyond our control.

We will do our best to keep Spk.sg and its sites, services, applications, and tools safe, secure, and functional. You acknowledge that we cannot guarantee the continuous operation of or access to our sites, services, applications, or tools. You further acknowledge that operation of and access to our sites, services, applications, or tools may be interfered with as a result of technical issues or numerous factors outside of our control. Stock availability, updates, pricing and other informative functionalities in Spk.sg applications may not occur in real time. Such functionalities are subjected to delays including, and without limitation, delays or latency due to your physical location or your wireless data service provider’s network. You agree that you are making use of our sites, services, applications, and tools at your own risk and that they are being provided to you on an "AS IS" and "AS AVAILABLE" basis.

In addition, we are not liable and you agree not to hold Spk.sg and its corporate entity responsible, for any damage or loss (including, but not limited to, loss of money, goodwill or reputation, profits, or other intangible losses or any special, indirect, or consequential damage) resulting directly or indirectly from cancellation of your order by SPK Singapore due to technical reasons or an error in stock allocation or price error or else, in our system and by our system.

You will defend, indemnify and hold harmless stance towards Spk.sg, its corporate entity, subsidiaries and affiliates, and their respective directors, officers, agents, employees, licensors, and suppliers from and against any cost, damage, expense, and liability arising out of or related to your use of the Service or products sold on Spk.sg, your violation of these Terms, or your violation of any rights of a third party. SPK Singapore strongly advice that all automotive parts have to be installed by qualified mechanics.

 

 

Placing an Order

 

Hunting for a specific auto part in a catalog may consume time. If you know our part number you can use our search bar to input it. Or you can find the right product in our product catalog by searching for key words e.g. “Brakes” “Filters” “Belts” or by narrowing down your part selection via filtering the maker and model of your vehicle.

If you can't find the auto part you're looking for, you may contact us via our office contact number, whatsapp, or send us a request via 'Contact Us' page. Just provide us with the part details and our support team will respond to you as soon as possible.

To ensure you're making the correct parts purchase, our system provides you with the image and details of the product you've selected, along with your specified quantity and the total amount due (including shipping fees). If everything is in order, fill up the required information on our Checkout page and make the payment to finalize your orders.

 

 

Large Orders

 

For large orders, you may use our quick order form (available only on registered accounts) – a formatted excel sheet – to input all your required parts (you can download the form on the same page). Once uploaded, the system will automatically check the excel sheet and respond accordingly. You may further modify the input for order processing, e.g. quantity, add / remove items, modify combination.

 

 

Cancellation or Amendment of Order by You

 

If you discover that you have made a mistake with your order after submitting, please inform us immediately via our office contact number, Whatsapp, or 'Contact Us' page. We will do our best to assist you, however, do note that there's no guarantee that we will be able to fulfill your request.

If you wish to cancel your order, please contact us via the same methods as stated above. No cancellation fees will apply, however, do note that once an order has been dispatched it may not be cancelled and we will have to proceed with the refund procedure.

 

 

What if the parts I purchased from Spk.sg don’t fit?

 

If you purchase a wrong part you can return the part for credit, exchange or refund as long as you meet the rules for the Return Procedure. The choice is yours.

 

 

Return Procedure

If you purchase a wrong part or for any reason, you are unsatisfied with your purchase, you can return the part for a refund. As long as you return the bought item(s) within 30 days of delivery of your order and without any damage or missing component, you will be eligible for a refund. Shipping fees are non-refundable. Refund will be made according to purchased invoice in the same currency, exchange gain or loss may be expected if your Paypal account or credit card is different from our invoice currency. The following rules apply:

 

  • Products must be in original packaging and in a new and resalable condition.

  • Any product that was used or fully/partially installed is non-returnable.

  • All returns must be made via our Return Procedure with a valid RMA form.

 

After we received the returned item(s), you will be issued a refund via the same payment method as you had originally used to place the order. The refund amount will be composed of the original purchase price minus shipping charges. Please allow an additional 5-7 days for the credit to appear on your account. You will receive an email confirmation or proof of refund.

 

To return a product you must first request a Return Merchandise Authorization (RMA). The RMA form will include an exact return address and detailed instructions on how to return a product. You may request an RMA using the following method:

 

 

Cancellation Order by SPK Singapore

 

We will try our best to ensure that the price and stock provided are accurate but we reserve the right to cancel an order at our discretion in case of an error, or product not being available for any reason

We will notify you if this is the case and refund any payment that has been processed.

 

 

Shipping

 

Spk.sg will make every reasonable effort to ship out on the same or next business day from when you placed your order and to deliver the shipments in accordance to SPK Singapore’s delivery schedules; however, this is not guaranteed and do not form part of these Terms and Conditions. SPK Singapore is neither liable for any delay, nor responsible for the consequences of a failure to deliver by a stipulated time. Delivery time is based on estimated delivery time provided by the assigned couriers.

At Spk.sg, our goal is to ensure your complete satisfaction with our products and services. If, for whatever reason, you are dissatisfied with your purchase, you have the option of exchanging the item(s) or receiving a refund for the full amount of the item(s) purchased. Refunds on returned items will be issued in the same payment form as tendered at the time of purchase. If payment was made by credit card, once we received the product(s) we will credit your account. Please allow 7-10 days for the credit to appear on your credit card statement. You can return purchased items to SPK Singapore within 30 days of purchase. Claims for missing or damaged items in transit must be received within five business days of merchandise receipt.

Your privacy is important to us, and we know that you care about how your order information is used and shared. We would like our customers shipping products internationally to be aware that cross-border shipments in some cases are subjected to opening and inspection by customs and/or postal authorities. Also, we may provide certain order, shipment, and product information, such as titles, to our international couriers, and such information may be communicated by the couriers to customs and/or postal authorities in order to facilitate customs clearance and comply with local laws.

Customs authorities require the value of the item to be stated directly on the package.

Items being shipped outside of Singapore will be subjected to import duties, taxes, and tariffs as imposed by the country the product is being imported to. The customer (the person importing the product) is responsible for paying the import duties and taxes incurred by customs when the product reaches the country of destination. SPK Singapore is not responsible for any duties, taxes, or tariffs incurred by the importation of products into countries outside of Singapore. The customer is responsible for paying all duties, taxes, and tariffs as billed by the courier and imposed by the customs and import department of their respective country.

 

 

Shipping/Order Processing Days, Duration

 

Our normal shipping and order processing days are Monday through Friday. No orders are processed or delivered on Saturday, Sunday, or public holidays. If you place an order on Friday after 1 PM, {UTC+8} your order will be shipped on Monday, as Saturday and Sunday do not count as shipping days.

 

 

Account Registration

 

You may register for and maintain an account to access additional features available to Account Owners, such as Information Tracking, exclusive promotions, additional order feature and etc. When you register, you agree to (a) provide accurate, current and complete information about you as may be prompted by registration forms on the Service (“Registration Data”); (b) maintain the security of any logins, passwords, or other credentials that you select or that are provided to you for use on the Service; and (c) maintain and promptly update the Registration Data, and any other information you provided to Spk.sg, and to keep all such information accurate, current, and complete. You will notify us immediately of any unauthorized use of your account or any other breach of security.

Accessing, Reviewing, and Changing Your Personal Information

 

You can track, review and change most of your personal information by signing in to Spk.sg. You are required to promptly update your personal information to avoid inaccuracy and subsequent issues that may derive from it. For account closure, you may submit a request to us. Upon your request, we will close your account and remove your personal information from our platform as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Spk.sg User Agreement, and take other actions otherwise permitted by law.

 

 

Account Protection

 

Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your Spk.sg password to anyone. If you do share your password or your personal information with others, remember that you are solely responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal and corporate information, and may be subjected to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify Spk.sg by sending in an email request to change your account password. For any account-related issue, you should only be sending in requests via your account’s primary (or registered) email, as we will only authorize requests in such scenario. This is to prevent any unauthorized personnel intending harm or misuse of the system.

 

 

We may also share your personal information with:

 

Members of Spk.sg corporate family to provide joint content and services (like registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about their products, services and communications.

 

  • Service providers under contract who assist our business day-to-day operations (such as fraud investigations, bill collection, affiliate and rewards programs).

 

  • Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, city, postal code, telephone number, email address, User ID history, IP address, fraud complaints, and billing.

 

  • Other business entities, should we plan to merge with or be acquired by that business entity. (Should such a combination occurs, we will require the new combined entity to follow this privacy policy with respect to your personal information. If your personal information is to be used contrary to this policy, you will receive prior notice.)


Without limiting the above, in an effort to respect your privacy and our ability to keep transactions free from bad actors, we will not otherwise disclose your personal information to law enforcement, other governmental officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

 

 

Security

 

Your information is stored on our servers located in the Republic of Singapore. We treat data as an asset that must be protected and utilize lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the Site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

 

 

Our Disclosure of Your Information

 

We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations.

 

 

A suspension or other action is taken with respect to your account

 

Your need to modify practices, content, or behaviour or your loss of or inability to do business, as a result of changes to this User Agreement or our policies; SPK Singapore reserves the right to modify its policies and this User Agreement at any time consistent with the provisions outlined herein.

Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not be applied to you.

 

 

Copyright and Limited License

 

The Service and all information, data, and other content and materials available on the Service, including, and without limitation, the Spk.sg logo and all designs, text, documents, graphics, software, videos, sound files, other files, and the selection and arrangement thereof (collectively, “Content”), are the proprietary property of SPK Singapore Pte Ltd and its suppliers and licensors and are protected by Singapore and international copyright laws.

If you comply with all the terms and conditions of these Terms, Spk.sg grants you a limited, personal, revocable, non-transferable, and non-exclusive license to access the Service and to electronically copy (except where prohibited without a license) and print to hard copy portions of the Content for your personal, and non-commercial purposes only. The Service is for your personal use and not for resale or further distribution. This license is revocable at any time.

Except as otherwise explicitly provided in this Agreement or as may be expressly permitted by applicable law, you will not permit or authorize third parties to reproduce, modify, translate, enhance, decompile, disassemble, reverse engineer, or create derivative works of the Service; rent, lease, or sublicense access to the Service; nor circumvent or disable any security or technological feature or measure of the Service.

 

 

Trademarks

 

SPK Singapore, the Spk.sg logo, and any other product or service name or slogan available on the Spk.sg and in any Content, are trademarks of SPK Singapore and its entity, suppliers or partners or licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of SPK Singapore or the applicable trademark holder. All other trademarks, registered trademarks, product names and company names or logos mentioned on the Service or in any Content are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise, does not constitute or imply endorsement, sponsorship, or recommendation thereof by Spk.sg.

 

 

Third-Party Content

 

The Service may contain links to Web pages and content of third parties (“Third-Party Content”) as a service to those interested in this information. Spk.sg does not monitor, endorse, adopt, or have any control over, any Third-Party Content. Spk.sg undertakes no responsibility to update or review any Third-Party Content and will make no guarantee to its accuracy or completeness.

Additionally, if you follow a link or otherwise navigate away from the Service, please be aware that these Terms will no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any Websites or Third-Party Content to which you navigate from the Service. You may access and use Third-Party Content at your own risk.

The Service may contain advertisements and promotions from third parties. Your business dealings or correspondence with, or participation in promotions of, advertisers other than Spk.sg, and any terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third party.
